Service Agreement - Subcontractor
This Contract for Services is designed to facilitate an agreement between a Service Provider and a Subcontracted Support Worker to provide services to NDIS participants.
There are clauses in the agreement covering claims from a Contractor for employee benefits such as Super and PAYG, however if you wish to ensure they are legally binding, please ensure you take it to a lawyer and do your research on the ATO website to ensure your Contractor cannot be classed as an employee.
Also covered are contract duration, responsibilities of each party, short notice cancellations, maintenance of insurances and competencies, conflict of interest, changes to the agreement, terms for ending the agreement early, feedback and complaints, definition of the relationship between the parties, list of agreed invoicing fees, list of services, whether travel and expenses can be claimed, and delegation of work to other contractors.
